Awareness/Capacity: Ensuring the signer understands the gravity of the document they are executing. The Actual Witnessing: Physically watching the ink hit the paper. If you sign before I arrive, I cannot testify under penalty of perjury that I witnessed the act. In the eyes of the law, the "witnessing" part of the process has failed. 2. Acknowledgment vs. Jurat: A Critical Distinction In Nebraska, there are two main types of notarial acts. Understanding these is the key to knowing when pre-signing is a "fixable error" and when it is a "total dealbreaker." The Acknowledgment An acknowledgment is the most common notary act. It is typically used for deeds, powers of attorney, and business contracts. The Rule: The signer does not technically have to sign in front of the notary. The Catch: The signer must still personally appear before the notary and "acknowledge" that the signature on the page is indeed theirs and that they signed it willingly.
