Its importance lies in both its durability and its statutory recognition: “durable” means that the authority granted continues even if the principal loses mental capacity, while “statutory” indicates that the document follows a state-approved format, which increases its acceptance by banks, institutions, and third parties. Without such a document in place, families may face significant delays, expenses, and emotional strain, often having to seek court-appointed guardianship or conservatorship to gain authority over a loved one’s affairs, a process that can be time-consuming and costly. By contrast, a properly executed statutory durable POA ensures continuity and efficiency, allowing bills to be paid, assets to be managed, and important financial decisions to be made without interruption. It also provides flexibility, as the principal can tailor the powers granted, limit or expand authority, and even specify when the powers become effective.
